COBRA and Medicare

COBRA feels like your old coverage. Medicare doesn't treat it that way.

COBRA lets you keep your employer's group health plan for a while after your job ends. But for Medicare, COBRA isn't coverage based on current employment, and misunderstanding that is one of the most common causes of Part B penalties.

The timing trap

If you delayed Part B because of job-based coverage, you have 8 months after your employment ends to sign up without a penalty. That clock starts when the job ends, not when COBRA ends. If you stay on COBRA past those 8 months without Part B, you may face a penalty and have to wait for the General Enrollment Period.

If you already have Medicare when COBRA starts

Medicare generally pays first and COBRA second. COBRA may still be useful, for example to cover a younger spouse or for drug or dental coverage.

If you become eligible for Medicare while on COBRA

Your COBRA coverage may end when you enroll in Medicare, and Medicare usually pays first. Sign up for Part B during your Initial Enrollment Period.

A guaranteed Medigap right

When COBRA (or other employer coverage that pays after Medicare) ends, you may have a guaranteed issue right to buy certain Medigap policies. Apply within 63 days of the coverage ending.

Common questions

  • Not safely. COBRA doesn't protect you from the Part B late enrollment penalty, and it may pay only secondary to Medicare.
